personal convictions/reasons should be kept out of law. besides, if he wanted to implement his whole idea of lets let a guy off and treat him, he shouldve at least tried this on a more minor case

Consider two individuals
The first is the head of a family of four. He lost his job due to a factory shut-down, and because of the economic collapse that followed, has been unable to find a job. As his life deteriorates around him he seeks other forms of income until, in desperation, he robs a convenience store. Everything goes wrong, and in the end, he is standing over the body of the clerk.
The other is a college aged frat guy. After pounding down 12 beers with his brothers, he gets behind the wheel of his car and, in a moment of alcohol induced brilliance, decides to turn the SUV down a hiking trail. The thumping noise that no one notices was another student walking home from a party - who is left to die in the underbrush.
Under the letter of the law, the first man would be eligible for the death penalty, while the other would get off with a manslaughter rap, or at worst murder II.
But which man is guiltier?* Human judgment is necessary to take into account the mitigating circumstances that surround every action. Were a judge to throw out his personal feelings, justice would not be served.
* Guiltier sounds wrong, but it really is the correct comparative form of guilty.

You cant rehabilitate a person by puting them in a cage. And frankly I haven't seen any instances of mental institutions working. Sure there are people who sit and rot for 10 years and then suddenly are proven innocent, but frankly if I were to get 10 years and then let out and I got to do it all over again knowing what the outcome would be I'd personally still rather die. I mean, I know it sounds lame but if your not getting raped or getting the shit beat out of you, the constant BORDEM is enough to make you lose your mind. Imagine having nothing to do, but eat sleep shit piss. Thats IT! (oh well, they have the holy bible if you want to read that)
And as for prisons having cable, such a joke that you people even give a shit. Have any of you ever tried to watch televison in jail? its impossible. The TVs are in your inmate cafeterias which are already so poluted with noise from the inmates not watching that the TV is impossible to hear. And in my experience, there were no captions. I mean hell, on second thought, may just as well get rid of it since its unwatchable. But its also the only look you'll have at a female for your time in there, which for some can be a long long long time.
Murder, rape, etc etc. Death penalty. Dont waste peopls money keeping them alive just so we can torture a person who was already tormented enough to comit the crimes they commited. Have a soul people.

My understanding is that you speak from experiance when it comes to the conditions inside, if not a federal prison than at least a state facility.
Even so, I think you're over-using the word "torture." Having an enforced schedule of nothing to do sucks - but given the choice between than and a workover with pilars and a blowtorch - I'll take the empty schedule and a small grey cell anytime.

so according to u, we should let prisonners enjoy their time in prison? dude, like killfile said, prison aint torture.
the one thing i have against north american prisons are that people jus get put inside. they should at least be put to manual labor to help the country instead of just sitting and there doing w/e they do with each other
